Told 'Ya So (Remittances)*

What did I say when Trump first put forward The Wall for Mexico, and Mexico said "we won't pay"?

I said the solution is simple: Cut off remittances.

And now?

In the memo, Trump said he would threaten to change a rule under the USA Patriot Act antiterrorism law to cut off a portion of the funds sent to Mexico through money transfers, commonly known as remittances. The threat would be withdrawn if Mexico made “a one-time payment of $5-10 billion” to pay for the border wall, he wrote.

smiley

PS: Oh sure, there would be litigation.  But it's litigation I suspect Trump would win.  What would be even more amusing would be to both do it administratively (drawing said lawsuit) and then send up a bill to The House and ask them to pass it explicitly authorizing it.  That would force Congress to go on the record -- either support illegal invaders as policy or pass the bill into law.  If they pass the bill that moots the litigation at the same time...  smiley

Unlikely. Anything is possible, but I've seen nothing that has changed my mind as of yet.

I still report on politics, you know.

For now anyway.

I wish he'd also come out in favor of enforcing the Immigration Reform Act. You fine the hell out of a few employers I have a feeling that millions of illegals will be without work and on their way home.

Again, RULE OF LAW.

The Executive can take care of this problem without new laws. Start throwing executives in prison and this crap will stop INSTANTLY.

Yep. You really don't even need a wall to keep out the ones taking our jobs. The wall really only needs to be there to stop criminals.

BTW when it comes to "home contractors" and similar it's trivially easy to enforce as well since in nearly all states you have to be licensed and permits have to be pulled along with a notice of commencement if you're doing it for money (that is, on other than your own house.)

You thus know who runs the company and where the crews are. Not hard.... toss a few company owners in prison and suddenly there will be no illegal Mexican roofers left.

Yep. And if you see enforcement you will see tradesmen turn in the offenders as well. An illegal roofer drives down the salary of a carpenter as well. People don't get it but it does. Supply/Demand. If you can't get a job as a roofer you go into another trade.

Employers who fail to fully comply with IRCA face significant legal, financial and public relations risks. Non-compliance, whether intentional or simply caused by oversight, has severe consequences imposed by DHS, as well as the potential of a corporate image tarnished by negative publicity. Unfortunately, most employers are unaware that they have a problem with Form I-9 employment verification requirements until they are audited by governmental authorities. By that time, it is generally too late to undo the damage.

The following is a partial list of federally mandated fines:

For employers who fail to properly complete, retain, or make I-9 Forms available for inspection, fines range from $100 to $1,100 per individual I-9.
For employers who knowingly hire or knowingly continue to employ unauthorized workers, civil penalties range from $250 to $11,000 per violation.
For employers engaging in a pattern or practice of knowingly hiring or continuing to employ unauthorized workers, fines can be as much as $3,000 per employee and/or 6 months of imprisonment.

Incidentally it is trivial to audit this via public information. Tax deposits are typically required within DAYS of payroll being paid out, and now it has to be done electronically (back when I ran MCSNet we had to run to the bank with the slip to make the deposit, now it's all online.)

The government thus KNOWS exactly how much was paid (from the tax deductions; Medicare is ratable, so the wage paid is instantly known via simple division) and to what SSN. This in turn means that game-playing is ALSO instantly able to be figured out and by the way Notices of Commencement filed with the building departments are public record so.... there you go.

Knowingly employing illegals is bad but TAX EVASION is a VERY serious federal matter and you can and will go to prison for it, not to mention having the IRS show up and literally chain your business door closed.

Not the IRS in my case, but workman's comp. Two business's run out of the same house, but because we structured the newest one as a C-corp and not an LLC we didn't get exemptions from workman's comp, even though we had no "employees" at the time.

Grrrrr.

The government stooge didn't believe my dad when he showed up with the cease and desist - my dad's business most definitely had employees.

The President could also order the IRS to stop issuing tax ID numbers to illegal aliens. That's a "workaround" that I understand is well-trodden.

In the event of a Trump presidency, you can bet this will be part of the machinery that BOTH wings of the uniparty will smash on the way out. I can just see obama, mcconnell and ryan meeting in the map room laying out the legislation that they will fast track for obama to sign to remove as much power from the executive that they can. In fact, I would fully. expect them to give obama his supreme court pick just for spite. Doubtful we'll get to find out since, as I have said for months, the gop has now openly said they will cheat and change the rules to screw Trump. A bigger "**** you!" to the voters I can't imagine. At what point do we need to start talking about treason being a real, actionable offense?

I remember hearing another twist on that one. Some roofing contractors would work a crew of mexicans like a pack of rented mules and when it got close to payday, call an anonymous tip to INS so they would get rounded up and deported before getting paid. Not sure if I believe the stories of that, but it's a hell of a way to cut labor expenses.

@TMD, those are not what I would classify as significant risks. Wake me when we start jailing the bastards the very first offense of knowingly hiring illegally. Fines only line pockets.

Goldman - 6 months jail time will wake the bastards up. So will $11,000 per violation. That's bankrupt a guy type money who hires 20 illegals to mow lawns or roof houses.

A friend of mine thinks I'm nuts to support Trump. He's a divison head at Monsanto. I wouldn't expect anyone at Monsanto to be for Trump. They will probably get hurt more than anyone if he wins. But I generally think he believes globalism is good. Not just for him and his company but for everyone.

Personally growing up in flyover country I can attest to how it's killed small towns.

In addition to those businesses that "employ" illegals, I would also suggest fining individuals that hire illegals in order to, for example, perform work in and around their homes, without first reasonably establishing and verifying that such individuals are authorized to work in their respective states and in the US as a whole. Perhaps a bounty could be awarded as well.

The reason for this is that, for example, where I live outside of our nation's capital, regardless of whether they self-identify as Democrats, Republicans, or Conservatives, most of my neighbors have absolutely no qualms with hiring illegals. These illegals do not work for American employers, but operate their own small businesses off the books doing any and all of housecleaning, yard maintenance, home maintenance, construction and remodeling work, etc. - just about anything one could think of. Need a tree taken down? Don't call the arborist or the accredited tree service, Miguel will climb up there with his chain saw, do it for $200, and even take out the stump. Need your yard weeded/mulched? Don't call the legitimate lawn service, Jose will do it all for $250. Need help moving? Just hire a few guys standing outside of home depot - who cares if they see all of the **** you own and also know where you live.

IN any event, one would think that given that 95% of my neighborhood is comprised of active/retired government workers (current/former members of government unions) or active/retired military, that each of my neighbors would be patriotic, rule of law types vehemently against the hiring of illegals, but alas, the truth is far from the case - they hire them wherever and whenever they can!

It is only us - the only people in our neighborhood that work solely in the private sector, who refuse to hire the illegals.

So, the way I see if, the problem is not just "the employers," but is more appropriately in the collective mirror of the American people.

Stop hiring them and they will return
