The essence of the ruling: Identity does not trump physiology.

Transgender activist Jessica Yaniv, a biological male who identifies as a female, filed at least 15 human rights complaints against female estheticians in Canada for refusing to wax his male genitals, as covered this summer by The Daily Wire.

On Tuesday, the Justice Centre for Constitutional Freedoms, which is representing five of the women being targeted by Yaniv, announced that the activist’s cases against their clients have been tossed by the BC Human Rights Tribunal. Moreover, Yaniv will be forced to pay $2,000 each to at least three of the women.

The man Mr. Yaniv lost.

Further, it was found that he filed complaints for improper purposes.

The ruling went further and stated that his testimony was disingenuous and self-serving.

Yaniv "identifies" as a woman but possesses a penis, scrotum and testicles.  Further, he is genetically male and there is nothing that he can do about it despite, from all outward appearances, very-much disliking his draw in the genetic lottery.

There are plenty of people who claim that identifying someone by their outwardly-obvious genitalia when it comes to their sex is somehow "violence" or "hate."  That's nonsense.   You are free to dress as you wish and to perform whatever cosmetic changes you wish on your own dime but exactly none of that obligates anyone else to "affirm", "like" or otherwise have anything to do with you.

I, personally, do not give a wet crap about your personal, internal demons.  They're yours, just as mine are mine.  But I have no more right to demand that you accommodate mine than you have to demand that I accommodate yours.  If I cannot comport myself in public and in interchange with others in society in a form and fashion where both parties give consent to same then no other person is required to put up with my crap.  If I am an ******* in a bar I may be ejected and the person who arbitrates that is the bartender or bouncer, and if I take that personally that's my problem.  If they're unreasonable in their decisions their business will suffer or even fail.

Commerce is lubricated with money and everyone's money is green.  When I ran MCSNet I faced incessant calls to privilege this group or that, whether it was based on their sexual orientation, race, religion or some other characteristic.  I refused all of these demands because irrespective of whether or not the specific preference in question was legal for me to preference on group or identity if I said yes that meant that by definition I screwed someone else.  That they couldn't identify the specific screwing didn't matter; the fact is that it would happen every single time, no matter how diffuse that screwing was, in that to give preference to one I had to disadvantage everyone else who didn't get it.

In this case Yaniv is physiologically a man.  He possesses male genitalia.  The procedure he requested is one that is performed on female genitalia, which he does not possess and thus the request was facially invalid.

That's the beginning and end of it and Yaniv took a direct knee to the nuts -- exactly as he should have.

My next question is whether Canadian civil law permits a lawsuit against him from those who he persecuted since it was found that he filed the complaints with improper intent.  $2,000 isn't all that much money; a couple of lawsuits for both actual and punitive damages for destroying these lady's businesses would be a much better deterrent against not only further abuse by Yaniv but anyone else similarly inclined.

Finally, will the cops up there in Canada now take the time to look at the IMs that were previously disclosed between Yaniv and others, specifically girls, some of whom appear to have been underage and thus could not give consent?
