Before you read the rest, do some googling on "balance billing." It will make the following much more meaningful. And, yes, I am currently one involved from a consumer end. Chargemaster of $2700, repriced amount of $130. I am being told to pay the $2700 because of "balance billing," and yet it was an in-network yet not covered service.
In 2017, in Ohio HB 52 was passed which mandated that healthcare providers provide a good faith estimate prior to service, except in the case of emergency. This was to eliminate "surprise billing" (google it).
On 12/22/16, in (relatively minor) Williams County Court of Common Pleas, a suit was filed by a plethora of provider advocacy groups (Case # 16CI000128) which requested an injunction for putting this law into effect because "providers of the state will be irreparably harmed." In 2/2019, the judge ruled for the injunction, claiming that the law, RC5162.80, "was unconstitutional."
On 3/14/2019, the State filed an appeal in Ohio 6th Circuit Court of Appeals (19WM000001, 19 WM000002 ... the case history nor documents is/are not accessible online).
