Hint: You just destroyed, permanently, any claim to your personal medical privacy.

Some states have laws about "private facts" and the USSC has repeatedly found that such a right exists with regards to one's medical status (e.g. Roe) but to be a private fact it must be reasonably treated as private by you.

Note that for a private fact to exist it must be private.  There is an exception in the law for things that are newsworthy and of legitimate public concern but absent that medical status is one of the areas where this law is routinely upheld.

If you make known to others without a legal duty of confidentiality that you are HIV+, for example, you cannot sue if someone discloses that because it's not private anymore.  Once you willingly make something public by your own actions it is not possible to return that item of information to the status of a private fact.

There are things that we remove from the status of "private facts" willingly and by our own hand.  Our true identity, for one.  You flash a driver license to prove you're 21 at a bar, for example.  Said bar has zero duty of confidentiality to you.  There are all manner of places where such is requested and we willingly comply.  By doing so we waive the private fact nature of that information since we willingly and intentionally display it in public.

If you go to a professional conference, for example, and flash a vax card or a digital app QR code at the door to "attest" that you had a Covid-19 vaccination you have released that information to people who have no duty in law or by contract to keep that information private.  Said app developer and owner has no legal stricture requiring said privacy either.  Further, by definition your mere presence in such a place, if such a pass is required for entry, voluntarily discloses your medical status to thousands of others! 

Again: Your mere presence in a business -- any business -- that requires such at the door waives your private fact protection.

I remind you that anyone can photograph you from or in a public place.  Never mind that damn near everywhere such is happening all the time in public anyway; there's a camera behind the bar in the restaurant, three more in the dining area, etc.  If you're walking down the street these days your next door neighbor probably has a camera on their doorbell and you were in a public place, namely, the street.

The minute you consent to a requirement for your medical status in some regard to be in a place open to the public you have, by definition and your own hand, destroyed any claim now or in the future that such is a private fact.

Thus you have now consented to your employer requiring you to document same since you already have made your Covid vaccination status available to the public on an unrestricted basis.  If and when something related to that (e.g. whether you have taken the sixth booster two years from now) is required of you you have already consented to that disclosure and discrimination because you, by your own hand, voluntarily gave up all right of privacy in that regard and consented to be discriminated  against.

Note that prior to Covid-19 there was exactly zero such attempt made.  Oh, people say, but the schools required vaccinations for kids.  Ah, but said entities were government agencies and had strict protocols for medical privacy.  Further, there were plenty of kids who didn't have all those shots in the school -- but nobody knew who they were.  If you had an exemption on whatever basis that was nobody else's business and exactly nobody had access to those records.  Finally, I attended college briefly in the 1980s (and took some classes while in High School too at a different college) and was never asked for a single bit of medical documentation before or while doing so.  All they were interested in was money.

Never mind that exactly zero parents were ever required to show anything about themselves to come through said door and pick up or drop off their kid, nor go to a parent-teacher conference, attend a basketball game or similar.  The entire time from the mid 1990s forward I was on school campuses every now and then for various purposes as my daughter was attending there.  Never once was I asked for a single piece of medical information.

Nor have I ever been so much as requested to document what I might have had (or been vaccinated against) to report for work anywhere, and I've been doing various jobs for more than forty years.

You didn't think about any of this, did you?

Well then you were really ****ing stupid to flash that card or show a QR code that instead of forcing said restaurant, conference, show or EMPLOYER to shove their demands up their ass -- and go out of business.

These abuses only stop when you make them stop by whatever means are necessary.  The time to do that was when they were first proposed and if you don't do it now the very first time you present such a "credential" you have given consent and thus you cannot have your privacy rights violated as you willingly gave that information up to the public at-large.

There is a wrinkle here - not sure how that is going to work out.

Employers are requiring their employees to disclose vaxx status on the basis of the mandates they are getting from the Federal government. For example, health care employers that accept Medicaid and Medicare monies are required to have a vaxxed workplace (or approved exemptions and testing process).

If you do not disclose your status, you are treated as unvaxxed by default.

Where the hell are any privacy rights in an era of forced disclosure? Some of my nurse colleagues have stickers on their name badges. Everyone knows what the stickers mean. Folks are being forced to give up their privacy rights! Do you really think an employer will keep vaxx status private? As for HIPAA ... HaHaHa.

FYI -- there is a website where the POS NYC Firefighters have to login to a personal account to upload their vexxine status and preferences. They passed around their grapevine not to answer until an option of "refuse to disclose status" was provided. Someone advised them properly in this regard. Was not their union with which many are not pleased.

I have been thinking about this stuff for a while. Lots of stuff about the medical stuff has been bothering me for quite some time. I suppose maybe it could be from watching Its a Wonderful Life but I remember when I would go to the pharmacy and we could watch the pharmacist count or mix your prescription. Now, you have no such opportunity. In fact, you cant even if you try or request it and in most circumstances these days, one is even mailed their scrips.
I always thought itd be the perfect assassination system and it bugs the everliving **** outa me to this day.
Next came the whole, we cant tell you what the meds cost until we put it through your insurance which had me shouting obscenities at drive-throughs all over town. What. The actual. ****.
I believe TG wrote about just that shortly after.
But still - all these Medicare people being directly mailed their drugs by the government? Are you kidding me?
How did Americans of all people get sold this bill of goods? Ive been feeling trapped in the asylum for a long time.

This is another great post TG. You have been providing regular excellent commentary and in volume recently.

I am going to adopt this very approach when I am asked by my employers, clients, any businesses I frequent or state officials or persons employed by the state to request such information from me. They cannot compel me to disclose my private medical information. I didn't see this as such an ideal place to begin making a stand on this issue but now that you've broken it down like this I can see just how important it is and how it cannot possibly be overturned (unless you yourself turn the information in)

This is just in time for the global 15th October date. I do hope that the message in this ticker is adopted worldwide by freedom-loving people.

This is a good time for a reminder of the addage: "the cost of freedom is eternal vigilance". This is exactly what a move such as this inspires. It is the beginning of reclaiming hard-fought rights our ancestors struggled to secure. No more nanny state and bribes. It's time to take a stand.

If everyone in every country who was requested about their vaccination status simultaneously said "none of your business" we would likely bring this thing to a head in a little over a month. Do not comply. Politely decline. Stand your ground and be prepared to walk away if you can afford to.

I have made my preparations for this as at some point I will be forced to choose under duress when the hammer falls. If I've already decided and have conviction in my decision, there isn't anything that they can do to me. I have picked a side.

I propose that this is an important time to stand by one's convictions and let it play out. Let's see time reveal those who chose wisely and those who chose poorly.

Went to Quest Diagnostics, this morning for blood work. Young lady checking me in slid a mask across the counter to me, stated, "just in case anyone gives you a hard time". I looked around, told her "anyone giving me a hard time would have to be nuts, I'm a pretty big guy". She looked up, her expression, "yeah nothing to worry about", put the mask in my pocket, declared it a souvenir.

**** the all of brainwashed *******s trying to control me.

At this point I have not disclosed anything to my employer despite them first requesting our vaccination status saying "It's Voluntary", but when 30% of the employees did not disclose, then they changed it to MANDATORY... and then threatened with more "AGGRESSIVE MEASURES" for employees that do not comply.

They have not (YET) announced any official Vaxx Mandate policy but made clear in the last email from the CEO that they intend to follow any Federal mandate.

Funny thing is, this is most critical and busy time of the year for the part of the company I work for and to make matters worse (FOR THEM) they are in the midst of a massive data center migration project that must be completed by end of December (only 6 months behind schedule and falling further behind daily!) or else they will face multi-million dollar penalties PER MONTH if they still occupy the current data center location come January 1st 2022.

They have NOBODY that can replace me for the normal day to day stuff and will be DEAD IN THE WATER to move close to a dozen servers and migrate a decade+ of historical data to NEW SERVERS in the new data center.

I can't wait for them to fire me!

I live in a commie state (WA). Our company is >100 employees but our owner is anti-vax and employees such as myself are wondering how he's going to resist given the fines. I am hearing that even companies as large as Amazon are looking into breaking up into subsidiaries that are <100 employees in size so as to retain the employees they have in this insane market (hard to find anyone to work). I am not a lawyer so I have no personal knowledge if this can actually be done successfully, but will be interesting to see going forward. RESIST!

Dr. Peter McCullough suggested another strategy to use against these corporate tyrants which is to ask them since Comirnaty is not available in the US, which one do you want me to take? Put it back on them so as to let them know they are on the hook for all liability since Big Pharma got a free get out of jail pass.

A lawyer I know is absolutely refusing to give anyone any information on his vaccination status. I asked why, and he said that it's a bigger deal than just giving out your vaccination status: simply put, the courts here in Canada have held that freely giving information of one kind can be construed to mean you don't care about that type of information being private. What this means is that if you flash proof of vaccination, you comprise your ability to argue that any medical status is confidential ever again.

I don't know if it works the same in the US, but either way, I'm never telling anyone my vaccination status ever again.

Once you cede a privacy interest in some particular thing it is virtually impossible to get it back again and that you ceded it will be used against you.

Good post, Tickerguy. I have refused to disclose my status to my employer as well. It creates one more hurdle for them to climb on their way to tyranny.

At some point, there is a reasonable chance that firing you for refusing to disclose status will put you in a different legal bucket than firing you for refusing the clot shot.

If everyone refused to "shut down non-essential business", this would have ended 18 months ago.

If everyone refused to have "papers" to travel, this would have ended 17 months ago.

If everyone refused to wear face diapers, this would have ended 15 months ago.

And so on. Make the communists fight for every inch. Don't give them anything.

Sounds like my company....we have data centers we are trying to migrate to/from by end of year and have been told it MUST be done.
(Though I'm on the software end of things, rather than ops or hardware - so it's not me having to do it)

Then I realized that there must be literally hundreds thousands (millions?)of IT folks who can't be released before end of year because so many mid-level managers have promised
other higher levels that the ________ (fill in the blank) would be done by the end of the year *no matter what*.
They are probably sweating it out wondering how they will comply by EOY and not cause everything go down sideways in a flaming holy ****-storm.

Gonna be an interesting Christmas....[****storm]
