You'd need to show particularized injury (standing) -- but yes, you could.

You need someone with a SEM (Electron Microscope); when you blow positive and are quarantined (injury) you then run the sample through the SEM and prove it's non-viable viral fragments.

At that point you have a slam-dunk lawsuit.

Great interview Karl. One wonders how the unfolding of what was discussed will affect the pre-retirement age people with income low enough to qualify for full Medicaid in the expansion states. They would probably feel the same effects as the people on regular Medicare. A lot of people living off assets and those with little to no income use this hack.

My 2 cents is that the option for health savings accounts is an attempt to get some people ready for changes in the program.

@Whitehat -- HSAs are worthless as "changes"; the problem is that without doing something about the monopoly cost issues unless you have a few extra million laying around you're ****ed if you need it.

Thus the only defensive measure that WORKS is to not need it. You can then put up the middle finger and, when it collapses, well, so it does. Big ****ing deal. They won't radically raise Medicare premiums because they can't; nobody can pay, so that won't be the solution. When you're 80% in the hole the "recovery rate" adjustment is 500% of what it was, which cannot be paid, so that's not a choice.

Obamacare made trying to build wealth from the point of enactment forward a losing exercise because once the subsidies start to phase out you're boned straight up the ass attempting it. It's hard enough as an entrepreneur in overcoming the natural forces of commerce that bias outcomes against you. That's part of the deal and there's nothing you can do about it. But that thumb on the scale is so large that it makes such attempts non-viable 99% of the time, and that's part of their goal -- to force you back down into the hole so you either work for a wage-slave outfit or you're on Medicaid. Well, when that blows up in your face you're going to die if you need it, and you won't die well either; most of the ways you will die are nasty, slow and they hurt. **** that. We've had 10 years to get the **** away from the requirement, and that's enough time for many. For those who legitimately CAN'T, well, make your peace with God or decide there is no God and take justified retribution so at least the score isn't 0-1.

The only reasonably-correct strategy is to get your nut down to where your depletion rate is low enough you'll be ok. That's impossible in many metros. It's definitely impossible in all the big ones, unless you want to live just above "on the street" level. But it's definitely NOT impossible away from said metros, provided you choose wisely. Even my kid is able to accomplish it, and I didn't guide her that way -- she deduced it on her own, granted, with what she learned, and made the decision that going for the brass ring was no longer reasonably achievable. If it becomes achievable again down the road then that's fine, but killing yourself playing Sisyphus is not smart.

yep Karl, you are right about the MSAs. We used to say to the gold and cash bugs that if you need something to eat there is no price only, "How much you got?" The medical extortionists (I know you call them monopolists which is correct.) function like a mafia and attempt to bleed people for everything that they have. They have the same mentality.

I am so glad that i decided to deal with my own stuff outside of the medical model and truly do not need them but for a few things that i can travel for or pay cash.
