Agreed. This is completely a state issue (if it is even a governmental issue at all). The laws of marriage between a man and a woman aren't even the same state to state. Some states recognize common law marriage while others don't (Florida does not). Therefore, you would have a situation where someone can be legally married in one state and then legally not married once they cross state lines. Where are the common law spouses demanding Federal protection?
