Are We discussing INSURANCE or CDOs written on the MBS? In the case of a Pile of CDOs there may be no 'policy' and therefor no Interest beyond that existing between the Counterparties as per the payment triggering event. If the 'insurance' is a heap of OTC CDOs there may only be default and payment parameters. There may exist NO contractural rights of any kind to the asset the CDO was written against!
