So Ginsburg is going to miss oral arguments -- for the first time.

I know what she's thinking because she's said so in the past.  She wants to "make sure" she retires while a Democrat is in office so she can "insure" her USSC seat goes the way she wants.

This, of course, is blatantly improper -- the USSC is not supposed to be a political entity.  But it's not actionable, because "supposed to be" (or not) isn't the same thing as a law, and there is no law that says the USSC can't be a political animal.  It runs contrary to the intent of the founders and any hint of common sense but..... what else is new?

In any event the facts are what they are.  She's old and now has had three bouts with cancer.  Cutting people up is never a good thing, and doing it to old people tends to be much more risky, even if you have the best money can buy (while you make everyone else have substandard care that bankrupts them and their families.)  Such is the "privilege" of Kings, you know.

But none of that matters to Brother Grim.  He doesn't give a damn about your privilege or politics. He comes when he feels like it and he takes what he wants.  No King, no USSC Justice and no President can bargain with him or, as is the common act of tyrants, threaten him.  Attempting either just elicits a guffaw in response.

The hard-left House will go bananas when RBG passes in the next year or so, and she shall.  It's not a wish or a desire for ill will, it's just odds and facts.  RBG bet her seat on Hillary winning and in fact inserted herself into the selection of our last President in 2016 -- an act that was and remains unconscionable.  Now she, and those on the left who cheered her on, are just going to have to deal with the reality of the day; you have a Republican President and solidly GOP Senate and in the context of a USSC appointment there is nothing the House or anyone else can do about how the nomination and confirmation unfolds.

Not that Ginsberg cares; as a member of the hard left she believes she's above not just the law but comity as well, and thus can do whatever the hell she wants.

She may be correct about all that and certainly has been thus far, but the guy she can't negotiate with or turn her nose up at is knocking on her door and she has absolutely zero control or influence over his level of patience.

Let the howling commence as I prepare to tip a glass.

I don't know, she may have more time left than you think. Reading the articles online about her the doctors are making all kinds of claims. They removed all the cancer, detailed body scans showed no cancer anywhere else in her body.

She may have gotten lucky that they caught the lung cancer super early given the broken ribs.

Time will tell.

I just can't figure out why these people don't retire in their 70s or earlier. Why in the world would you want to work until you are a shell of your former self in your mid 80s. Same goes for Pelosi.

When she croaks, it could ignite mass rioting. The left was bad enough over Kavanaugh replacing Kennedy. They will go over the edge when this old bag croaks and is replaced by Barrett or someone similar. I would say the one semi decent thing Trump has done are his nominations to SCOTUS (although I do not like Kavanaugh based on his past rulings).

I doubt she has had three bouts with cancer. Sure, that's the spin, but it's more likely her original cancer has metastasised, first to her pancreas, and now to her lungs. I would lay odds she also has cancer in her liver and her brain. I haven't read anything about her receiving chemotherapy. My guess is she's to far gone for chemo and they have her on palliative care.

@Scd -- Yep. I said that originally..... very, very unlikely that she actually has had three UNCONNECTED cancers.

If I remember correctly one of the previous cancers involved chemo. She has almost-certainly hit the lifetime limit on that (there is one) and that's no longer an option, whether she wants it or not.

If she misses oral arguments when the USSC is in session, then does she have to abstain from voting?

According to Wikipedia (please don't berate me):

"Customarily, justices who were not seated at the time oral arguments were heard by the Supreme Court do not participate in the formulation of an opinion. Likewise, a justice leaving the Court prior to the handing down of an opinion does not take part in the Court's opinion. Should the composition of the Court materially affect the outcome of a pending case, the justices will likely elect to reschedule the case for rehearing. "

If so, precedent says she isn't voting on a case when she isn't in court to hear oral arguments. I wonder if her cadaver will be hauled into court while Trump is still POTUS. Weekdays at USSC version of Weekend at Bernie's.

According to the USSC Website:

A quorum of six Justices is required to decide a case. Justices may also participate in a case by listening to audio recordings of the oral arguments and reading the transcripts.


It doesn't say whether they are required or its customary to abstain when missing oral arguments.

RBG has had her staff make her decisions for over a year now, she has totally lost it. In her last interview, she had no idea what was going on. This is an absolute disgrace, if you can't medically and mentally do the job, you should be forced out. She will never recover from this, it will only get worse from here, how can she possibly make a sound judgment, how can any of her staff's decisions be honored?

"She had no idea what was going on" That's exactly what someone close to me said when she was in her last months with brain cancer. She couldn't comprehend enough to read the newspaper or pretty much the simplest things probably because it affected her left hemisphere. Very painful to watch as she was someone with a real sharp intellect in her day.

If that's where RBG is at, then yeah it's over. I almost feel sorry for her as they are keeping her drawing a breath as long as possible.

That attitude is diametrically opposed to what the "public employee" unions have managed to virtually get cast in concrete for gov't employment.

Couple that basic philosophy with:

1. It's a lifetime appointment, with zero mention of a requirement for having the capacity to do the work,
2. Having Ginsburg's clerks write decisions is just as good for the left as if she herself wrote them,
and 3. The unacceptability (to the left) of a non-socialist appointing another Supreme Court justice

leads to the IMO inescapable conclusion that she will remain a justice until rigor mortis has set in, perhaps much longer if they can get the doctors to hide the fact.

Indeed. Pancreatic cancer is known to spread to the lungs. I also seem to recall that a genetic mutation exists that predisposes one to both pancreatic and colon cancers.

I think she's worse than we're led to believe. Part of me thinks they'll keep her on a respirator until Trump is out of office. She did want the South African Constitution for Egypt. That's all I needed to know.

They may know she's toast and won't last until 2021, but if they don't suppress that news, her seat becomes a tool the GOP can use to bring out the vote in 2020.

Not gonna matter if she goes this year though. Probably better for the GOP if she lingers.

Here is the scenario that I can see happening that would have the left going crazy.
If she becomes further incapacitated, Trump can go ahead and nominate her replacement. Remember, there is nothing in the constitution about the number of justices. FDR threatened to 'pack the court' when they would not approve his New Deal programs.
