It really isn't.

The latest attack is that Kavanaugh lacks the temperament to be a Justice.

Oh really?

So one who wishes to perform a public service job, no matter the position, is supposed to sit and be questioned by people who have referred to you as "evil" and accused you of being a serial gang-rapist -- a capital felony -- without one shred of evidence and yet be polite in response?

I think not.

In fact the proper response to that is "pistols at 20 paces, *******!" and it wasn't that long ago where such a statement would merit exactly that response.

Funny how people didn't make that kind of claim unless they were willing to duel over it.  The potential for being immediately drilled in response to such a statement has a powerful effect in focusing your mind before your yap opens and, if it doesn't, then you tend to be removed from the gene pool.

No, my issue with Kavanaugh and the entire rest of the court, which I argue renders it entirely moot and something that the people of the United States should erect a big fat middle finger to (and dare the Justices to try to enforce their rulings) rests in this lie:

Kavanaugh concluded that if he's confirmed by the Senate to the vacant seat on the bench, he "will keep an open mind in every case and always strive to preserve the Constitution of the United States and the American rule of law."

Nonsense.

The First Amendment opens with Congress shall make no law.

It then lists Freedom of Speech, Freedom of the Press and Freedom of Religion as three things Congress may not abridge through any law.

In addition the Fourth Amendment requires a warrant before a search can be conducted, signed by a judge, demonstrating probable cause that a crime has been committed.

Yet Kavanaugh has opined in formal rulings that NSLs (National Security Letters) are Constitutional.

No, they are not.

First, they permit searches and seizures without prior judicial review and without a finding of probable cause.  They are an administrative subpoena and by definition administrative subpoenas are all flatly unconstitutional.

Second, they contain a gag clause.

As such they violate both the First and Fourth Amendments.  Any judge or justice ruling such are constitutional has violated their oath of office and declared themselves in open armed rebellion against the Constitution of the United States since these outrages are inevitably served and enforced by armed members of the government.

recipient of such a NSL has every right under our Constitution to refuse that demand.  Of course that would result in said person getting shot, right?

THE MERE ISSUANCE OF SUCH A DOCUMENT IS A NULLITY AND THUS WHEN BACKED UP WITH THE THREAT OF FORCE SINCE THE PREDICATE CLAIM IS VOID THE MERE SERVICE OF SUCH A "LETTER" IS FELONY ASSAULT WITH A DEADLY WEAPON BY THE PERSON PRESENTING SAME.

In addition Kavanaugh believes in a "usual" test for firearms laws.  The Second Amendment, on the other hand, is clear:

The right to keep and bear arms, shall not be infringed.

If you fail to understand how to parse the preamble to that statement and the difference between a dependent and independent clause go back to Grammar School. If you fail to understand that a right is something humans have that pre-dates government then you are either ignorant or a tyrant yourself.

The simple fact of the matter is that the NFA, GCA, Brady and more are all unconstitutional.

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

The 2nd Amendment is clear: The dependent clause explains why the right of the people to keep and bear arms, a right all persons have and which in fact pre-dates all government, shall not be infringed.  If you read The Federalist and Anti-Federalist you will find that both groups debating the founding of the nation agreed that the federal government had no authority to regulate the arms owned and born by or to disarm the citizens AT ALL under ANY circumstances.

Indeed the entire debate among the Founders rested on whether the 2nd Amendment was necessary since both sides took as a matter of natural law the entire citizenry had a fundamental right to be armed in any way they so decided and to bear said arms when they wished or needed since such was an utter necessity arising from the natural law right to self-defense. Indeed the entire purpose of the Second Amendment is to enable you to say no to tyrants, whether the petty sort that robs you in the street or the organized sort that wear uniforms while claiming some government mandate and mean it.

The Second Amendment is not about hunting deer.  It is in fact about enforcing the natural law right to peaceful secession should it be asserted and the existing government reply is "NO!" -- exactly as the British Crown did.  May I remind you that the shooting started over exactly that point; the British attempted confiscation of powder and ball....

Shall not be infringed means what it says.  It leaves no wiggle room and it doesn't say "except for machine guns", "except if there are terrorist attacks in the country", or even "except if you previously committed a crime but have been released from court supervision."

If gun control advocates had passed such a Constitutional Amendment including such phrases then it would be constitutional, albeit still a violation of natural law.  But that hasn't happened and the historical record on the part of the Founders is not debatable.  Don't believe me -- go pick up The Federalist and Anti-Federalist and read both as they are the canonical source material.

Now granted, Kavanaugh is better in regard to the Second Amendment than many justices, before and now.  But that's like asking me if I'd like to get raped up the ass with the first inch of someone's penis or all eight inches, rather than having the debate be over whether******should be permitted in the first place or the attempt should be answered by a date with the gallows.

There is no question as to what the First, Second or Fourth Amendments say.  The question for today is one of time -- specifically, for how much longer the people will submit to a bunch of black-robed tyrants who have intentionally and serially, over well more than 100 years, ignored the very foundation of our nation while demanding that we perform fellatio upon them to suit their particular fetish-of-the-week any time they pick up a pen or open their mouths.  The question before us, in short, is at exactly what point we the people will again assert "That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness." -- and mean it.

Kavanaugh has no more right to call himself a Justice than does Stevens, Sotomayer, Kagan or for that matter the late Scalia.  Upon violating their oath of office for the first time all of them have voided any right to demand compliance with anything emitted from their putrid orifices and digits.

So no, this isn't really, from my point of view, about temperament.

Nor is it about drinking.

Or even about whether Kavanaugh stuck his penis in a college girl's face or grinded on Ford -- neither of which, by the way, I believe.

No, it's really about Congress and the court itself distracting you from the fact that the entire court is illegitimate and so is our Congress, both having voided their own right to demand anything from anyone by their own actions long ago and continuing to this very day.

THAT, and what we're going to do to address it, is the debate we should be having in this country in a political context before a bunch of someones decide that the only answer is to once again declare that the nation is too small for all of us to live in at once and further political debate is pointless.

We did that at Ft. Sumpter.

It got really sporty.

So, I hope I don't get the *ban hammer* here, but all of this has me really thinking.

Trump could have dismantled the spying on citizens apparatus a long time ago. An apparatus decades in the making. Now you get Kavanaugh on board - one of the authors of the Patriot Act and many anti-4th decisions, plus the Dems made it a point to publically humiliate him and attack his family. Any human is going to have an ax to grind after that.

THIS is Ft. Sumptner, Karl. Before that is was rumblings of civil war and skirmishes in the streets.

Trump now has all of the goodies in place, with Kavanaugh soon to be confirmed, and hell will be unleashed.

Some folks are clapping and celebrating - I don't think folks realize FULLY what the ramifications of all of this are.

Thank you, Karl. A most excellent ticker and worthy of wide dissemination.

All of the Roe v. Wade, drinking, sexual, and/or other allegations, whether true or not, have all been a sideshow to the real issues that you present, and very few people are even aware of them, much less care about them.

For the reasons you cite and more, IMO, a large majority of public officials, politicians, and members of the judiciary, including the Supreme Court, are more deserving of being lamp post decorations than of being paid by us to actively subvert the Constitution and turning this nation into an authoritarian police/surveillance state.

I agree that the court has definitely overstepped their bounds in several issues and violating the 4th amendment is one of them. We don't even know how many of the social media platforms are actually working for the NSA, CIA or FBI and supplying them with data on individuals illegally.

When the court approved the extortion payment on Obamacare, I think I broke a couple of things I was so pissed because they way overstepped their bounds on that one. They made law instead of interpreting it and it has hurt a lot of hard working Americans in the process. It was purely political and you had to be braindead not to see it.

If Kavanaugh sticks to the Constitution, then I think he will make a good judge. I think they need to give these judges terms and no more life appointments. Ginsburg is basically senile and this needs to stop. Knowing that you give someone an appoint for life, simply is as bad as these congress critters staying in office for 40 years. We need term limits on everyone.

J.R.R. Tolkien's novels were a favorite read of my oldest son. He gave up trying to convince me to read the series. But I have read excerpts and reviews. I also watched the movies years ago.

Karl recently made the comparison between Mordor and Washington D.C.. And I think that's what Tolkien was actually warning about in his novels, i.e., the vicious struggle for the power to rule... to become "Lord of The Rings".

A vicious power struggle is what is playing out now. Donald Trump has begun a hostile takeover of Mordor. And the Dirty Democrats are as crazed as Smeagol was over losing possession of "The Precious".

This entire political battle between the Democrats and the Republicans is about who shall wear "The Precious" Ring of Power. Who is going to be "Lord of The Rings"...

Frankly, I don't think there are really any good guys in this fight. There is only the lesser of two evils to choose from or none of the above.

I choose Kavanaugh. Mostly because I want to see the Dirty Dems become so desperately deranged that it is obvious to even the most dimwitted American that the Democrats are the party of
Smeagol. And it's actually working. As each day passes, the Progs' "temperament" is looking and acting something like a gollum right out of the movie, "Lord of The Rings". The Dirty Dems think Trump stole their Ring.

Trump Derangment Syndrome is real... And the Prog Gollums are going crazy with desire to get The Ring back... And I actually hope that tomorrow Mike Pence has to break a 50/50 tie... That will drive the Gollums into a frenzy....

I'm going to stock up on some extra popcorn and "beer" for tomorrow. Does anybody happen to know what brand Kavanaugh drinks?

Karl has made some very valid points here and I doubt there are few true Constitutional Strict Constructionists out there to put on the court that would stay true to the founders.

In fact I would imagine that the court has been devoid of true Constitutional advocates since before Roosevelt came into office and started packing the court with Liberals.

Progressive Politics of the last 100 years have brought us nothing but misery and of course the 17th Amendment that destroyed the balance of power between the Federal Government and the States.

I don't think there is any doubt that the USSC has become totally Political and the decisions for the most part are based more on Politics than any real Constitutional Logic.

Lets just face it, all branches of Government have become totally corrupt and I am not sure there is much hope.

We all know that the Democrats are Marxists ideologues who work assiduously to promote their beliefs. The republicans are eternally presenting themselves as defenders of the constitution and promise to roll back big government when/if they get control of the House, Senate, and the presidency. Just wait until they get enough power; they can appoint constitutionalists to the supreme court and restore our freedoms. These promises are never fulfilled. The only thing that Republicans stand for is reelection. We are presented with a nominee for the supreme court whose actions and beliefs are inimical to our constitution as pointed out in this Ticker. I've read that he also had some part in the Vince Foster investigation/coverup. Given the above, the Democrats protestations about Kavanaugh may be like Brer rabbit begging not to be thrown into the briar patch.

I think it will be riots and bullets. What else can they do?

It's not like they are going to lay off a woman. They don't give a ****. It isn't about identity politics, but power, and if Amy Barrett is in the way, she gets destroyed.

How they do it without violence? No idea. Rest assured, they already have a dossier and battle plan in place, as they do with all conservative Appellate court judges.

The next one means it is 6-3, and if it is that bad, why would Bryer stick around? DJT could conceivably nominate 44% of the USSC by the end of this presidential term.

One. Collins and Murkowheelbarrow both vote no, and Joe Manchin votes yes.

Two. Collins and Murk split their vote, and Joe decides he doesn't want to be a senator any more.

Because if he votes No, his 8pt lead in WV will vanish in a microsecond.

I know this much: the Left isn't just going to roll. over if Amy Barrett is nominated to replace RBG. They either have something or will do something.

Truth isn't a barrier.
Philosophical consistency isn't a barrier.
Constitutional restraints are not barriers.
Preservation of civility is not a barrier.

We also know they are unhinged. We know they are prone to violence. We know the USSC has been the way they have achieved victory in the Culture War over the past 50 years, and they, unlike Republicans, know that politics is downstream of culture.

If they don't take the Senate and/or House, they have almost no option, other than violence.

Our current president has been the best in my lifetime. In my opinion. I'm open to hearing what other president was better.

In my industry, the automotive industry, we are desourcing Chinese content.

The economy around these parts is better than it's been in awhile. Help wanted signs everywhere.
