Well of course they did. I still think Trump should pardon Assange and bring him in to sit down with Trump and Mueller. Just the three of them in the Oval. Find out the truth and go from there. Show some balls Mr. President.

I say of course they did. I'm talking of some of the FBI - not all of them. But enough that it's rotten to the core. It needs to be brought to it's knees. This calls into question every conviction this ******* was involved in the investigation of.

I honestly don't know what Assange is guilty of? What would you have done if given the emails? I know damn sure that Trump emails given to the NYT would have been published. I think DJT should have pardoned him long ago.

Serious question:

Is it even possible for the president to commit obstruction of justice? It's a "by definition" argument, given that all executive (and law enforcement) powers, are contained within the Executive Branch, and the entire branch is wholly accountable to the POTUS?

I'm not talking about the political fallout of any executive actions. That is covered under the impeachment process, where "high crimes and misdemeanors" are whatever Congress says they are.

Congress, by definition, can't put part of the executive branch above the president, just as it can't create a court superior to the USSC.

My personal opinion is that what he has done couldn't be prosecuted as obstruction. You will get different answers from different people on that. But if he tried to run Mueller off the investigation and we find out that Jared was talking to Russians about emails??? Then you have a case for obstruction for sure. And that would probably get him impeached and possibly thrown out of office.

My question is it even legally possible for the POTUS to commit obstruction of justice, since he has plenary power to pardon anyone for ANY reason or fire anyone in the Justice Dept, including a special prosecutor.

It is flatly unconstitutional for the Congress to put anyone in authority over the President, just as they cannot, no matter how they write the law, to put any court above the Supreme Court.

It's a "by definition" question.

I will readily admit that any smiley that comes from pardons or firings are ample material for Congress to run impeachment proceedings, but then again, Congress can impeach the POTUS because he farted in church. Impeachment is not a legal proceeding, but a political one. Right and wrong has nothing to do with it.

Now Alan Dershowitz is not a SCOTUS Justice but he's pretty highly respected. He doesn't think what Trump has done is obstruction but when pressed he gave the answer I shared above. If the POTUS were to shut down an investigation which would lead to him that would absolutely be obstruction. Shutting down an investigation which might lead to him would only be obstruction though if they proved he had committed crimes. In that case obstruction would be the least of his problems. I'm not sure that I agree with Dershowitz on this. It would seem that shutting down an investigation which would lead to family could well be considered obstruction. But I've received all my legal education watching LA Law and Boston Legal. And those shows have been off the air a long time.

Obstruction is not predicated on who the target is; there is utterly NOTHING in the statute that says "it's only obstruction if the target is you or someone you like."

That's Alan Doucheowitz who is once again reading into a statute words that are simply not there.
