From the AP:

He was committed to a mental health facility in Santa Teresa, New Mexico, but at some point escaped and was later found by police at a bus station in downtown El Paso in June 2012.

That makes two separate instances regarding the Texas Church Nutjob in which a government agency failed to comply with the law and as a direct result people are dead.

I remind you that involuntary commitment (which requires adjudication of mental incapacity under due process of law!) to a mental facility is also disqualifying for firearms purchases.

You cannot "escape" unless you were there involuntarily!

This is not a "mental health problem at the highest level" as Trump has said.  Many people are mentally ill but it takes criminally gross negligence for multiple government agencies and parties to know about that, have both a legal requirement and duty to report same to the appropriate parties and willfully ignore said legal requirement and duty.

Further, the details of that "confinement" have emerged: He tried to smuggle weapons onto a military base for the purpose of murdering his superiors -- a fact known because he had previously made threats to do exactly that.

This incident in Texas was in fact the product of criminal gross negligence by multiple federal and state actors all of whom had a duty under both law and regulation to act.

WE THE PEOPLE MUST DEMAND THAT EVERY SINGLE FEDERAL, STATE AND LOCAL EMPLOYEE WHO WAS GROSSLY NEGLIGENT IN THEIR FAILURE TO FOLLOW LAW AND REGULATION IN REPORTING BOTH THE COURTS MARTIAL AND, APPARENTLY, INVOLUNTARY MENTAL CONFINEMENT AND ESCAPE BE CHARGED AS ACCESSORIES BEFORE THE FACT TO THE MURDERS WHICH THIS NUTJOB COMMITTED.

WE MUST NOT ACCEPT ANY "GUN CONTROL" OR "GUN SAFETY" ARGUMENTS; THERE IS NOTHING WRONG WITH THE PROCESS.

RATHER THERE IS A COMPLETE AND TOTAL LACK OF ACCOUNTABILITY FOR GOVERNMENT EMPLOYEES WHO FAIL TO FOLLOW THE REQUIREMENTS OF THE LAW WHETHER THAT PERSON BE HILLARY CLINTON, MEMBERS OF THE AIR FORCE OR THOSE IN CHARGE OF SAID MENTAL FACILITY COMMITMENT AND SUPERVISION.

THIS MUST END NOW WITH INDICTMENTS, IMPRISONMENT AND PERSONAL FINANCIAL LIABILITY ATTACHING TO ALL SUCH PERSONS IN FAVOR OF THE FAMILIES OF THOSE DECEASED AND INJURED.

IF IT DOES NOT END RIGHT NOW AND COURTS MARTIAL, INDICTMENTS AND ARRESTS DO NOT ISSUE FORTHWITH THEN **** JEFF SESSIONS, **** THE FBI, **** THE ENTIRE DEPARTMENT OF "JUST-US" AND **** DONALD "YOU LYING SACK OF ****" TRUMP.

I never saw a leech, lamprey or a flea, nor any other parasite for that matter let go of its host simply by asking, demanding, writing letters and stomping your feet. They have to be physically removed, burned off, or drowned in hot oil or other substances.

it took a long long time but they got it just the way they like it.

I guess this validates a post I saw yesterday on ....................... Here's what the guy posted:

"...I personally arrested Kelley in 2012ish on Holloman AFB. Guy was a total douche. He beat his stepson so badly he broke his clavicle. He also held a gun to his wife's head. He sat in our confinement facility for a significant time. He was escorted in shackles everywhere he went. He actually went to a mental health facility for evaluation and escaped. He was caught by local authorities if I remember near the El Paso airport..."

"...Anyway, after he was convicted his dad begged the military to take all these kid's guns. Legally we weren't allowed to do that as the weapons weren't registered nor in his physical possession. Kinda brings it home though. His own dad tried to get those guns out of his hands and now here we are a few years later. Dude was a mental piece of ****..."

Why on earth would anyone even talk about changing or adding new laws, in response to a tragedy like this, when we have plenty of laws on the books that had they been enforced, would have prevented it?

My conclusion is that nobody in a position to make a difference really cares anymore. Your outrage is highly justified.

Amazing isn't it? Over 40,000 gun laws on the books for almost ever conceivable possibility and yet this guy slipped through the cracks and it is the Government's fault all the way down the line. And why,well that is the big question. Are we to blame the data entry people for failing to do their jobs, stupidity, laziness, you name an excuse. The reality is that the Democrats and others want more Laws yet the very institutions they are citing and depending on the enforce such laws failed, failed miserably and will continue to do so.

When all these investigations are done who will be the scapegoats for these failures, probably some small cog in the wheel overwhelmed by work who took a shortcut and now gets burned.

At this point, I can only conclude that all our laws are on the books so you CAN be charged with something IF you run afoul of the wrong people. Otherwise, you are free to commit crimes over and over and over again until someone stops you. Then the system will decide, in a pretty arbitrary manner, whether to lock up forever or shake the hand of the person who did their job for them.

Whoever they blame it on, I bet they get more time than bergdal. Also, I just read that he was caught trying to sneak firearms onto the air farce base too. Yeah, this guy was missing five beers from his sixpack. And a security guard for a water park? The hits just keep coming.

I know that she (generally) isn't overly well thought of around here, but to Ginnie's point:

Yeah, the quote doesn't necessarily go to the laws that Gen is railing about that weren't followed in this instance. Those laws are pretty clear, specific, and applicable. However, the quote does go to Ginnie's point.

I was going to respond to Jfms' comment that in all likelihood there are so many (unconstitutional) anti-gun laws with layers upon layers upon layers of bureaucracy meant to implement and enforce them, that these types of folks probably get dropped through the cracks all the time. We would probably be mortified that there are likely many many more of these types folks out there than we will ever know about - till they snap that is . . . .

But that in no way absolves any of the folks who should have followed up on this guy. They DO need to be held to account - if for no other reason to make an example for future cases. Gen's points all along are spot on. With no accountability and no enforcement of the laws at any level - there is no reason that normal folks should be following the laws themselves. At some tipping point, I am afraid that we may well get there unless someone starts actually enforcing the law (cough Sessions, cough cough Trump, . .. . )

Nothing new here in agencies of 'Government' failing to do their job as Karl has shown us over and over and over, etc.

What is new is that some of the 'Media' has started to report on it.

The sad fact is that once a 'Government Agency' is created, its 'Job One' is to preserve and grow its budget and NOT to perform the 'public service' for which taxpayers pay for.

The examples of corruption in Government at all levels (local, state, and federal) are just too numerous to list.
