My oh my what's this?!

Attorney General Chris Koster today announced that the state of Missouri and Lorraine Brown, former President of DocX, LLC, have reached a plea agreement.  Under the agreement, Ms. Brown will plead guilty to one felony count of forgery, one felony count of perjury, and one misdemeanor count of making a false declaration.

Brown will be sentenced to a term of imprisonment of not less than two years and not to exceed three years in the Missouri Department of Corrections.

Ms. Brown is the former President of the company DocX, LLC.  During the period of March to October 2009, DocX, at the direction of Brown, instituted a surrogate signing policy whereby employees signed, not their name, but the names of other employees on thousands of mortgage documents that were notarized and filed across the country.  Prior to 2009, similar signing practices were also employed at DocX.  Brown concealed these practices from her clients, the national mortgage servicers, and the parent company of DocX.  The practices of DocX were brought to national attention by a “60 Minutes” report and resulted in several major lenders temporarily suspending foreclosures in 2010.

And that's not all!  It be Federal too....

The guilty plea of Lorraine Brown, 56, of Alpharetta, Ga., was announced by Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division; U.S. Attorney for the Middle District of Florida Robert E. O’Neill; and Michael Steinbach, Special Agent in Charge of the FBI’s Jacksonville Field Office.

The plea, to conspiracy to commit mail and wire fraud, was entered before U.S. Magistrate Judge Monte C. Richardson in Jacksonville federal court.  Brown faces a maximum potential penalty of five years in prison and a $250,000 fine, or twice the gross gain or loss from the crime.  The date for sentencing has not yet been set.

“Lorraine Brown participated in a scheme to fabricate mortgage-related documents at the height of the financial crisis,” said Assistant Attorney General Breuer.  “She was responsible for more than a million fraudulent documents entering the system, directing company employees to forge and falsify documents relied on by property recorders, title insurers and others.  Appropriately, she now faces the prospect of prison time.”

What happens to those that bought a foreclosure and moved in?

Do we have a house lawyer, very familiar with real estate law? There is absolutely no way this could be completely unraveled. Like Marvin says, what happens after there have been legitimate transaction after legitimate transaction piled on top of illegitimate ones? And OMG, the scale of the claims against DocX could be many billions if not trillions (if for example, the triggering of CDS could be blamed on such forgeries). Think I'm crazy? Did DocX sign off on faked income statements and the like? I wonder what this will do to the markets?

Glad to see it. But she could have gone to jail for a much, much longer time.

"The forgery and false declaration counts each allege that the person whose name appears on 68 notarized deeds of release on behalf of the lender is not the person who actually signed the paperwork."

"Forgery is a Class C felony and False Declaration is a Class B misdemeanor. If convicted on the most serious count, Brown could face up to seven years in prison for each count. DOCX could be fined up to $10,000 for each forgery conviction and $2,000 for each false declaration conviction."

This case is being prosecuted by Trial Attorney Ryan Rohlfsen and Assistant Chief Glenn S. Leon of the Criminal Division’s Fraud Section and Assistant U.S. Attorney Mark B. Devereaux of the U.S. Attorney’s Office for the Middle District of Florida.  This case is being investigated by the FBI, with assistance from the state of Florida’s Department of Financial Services.

Read the warranty section on the deed. If an unraveling were to occur, the folks who bought foreclosures could end up a wee bit unhappy, especially if they bought without general warranties but provided warranties when they sold.

From what I've seen and read, the original notes no longer exist. A friend went thru foreclosure and she couldn't get a copy of the note. Her note was sold to Fannie. Short of hiring an attorney (which she couldn't afford) there was no way she could get a copy. I suspect the originator shredded the original after they sold it thru MERS to Fannie.

Also, many of the originating businesses no longer exist. IF they pursue this thing, it'll be a megasized can of worms. She must be turning evidence or something, they had her on many instances of this yet she pleads to just one count each for up to 3 years? Something stinks.

LPS is mostly service fraud and foreclosure fraud, not sure how much they were involved in MERS juggling to get those trusts in line.
Countrywide and Wells Fargo insiders both reported all original documents were stored in mines in Utah instead of being forwarded to trusts and agents.

Now we need a murder indictment in Vegas.

You don't get your house note back and you don't get your cancelled original checks back anymore either. Somehow, this seems like the way banks do business now. Not saying it's right. Just saying they seem to share some paths on banking algorithms for document handling.

We have been hearing from the start that the titles were destroyed or lost or sent off to a mine or they are at NY melon.

They better not have been destroyed. If they were all pensions are toast. This was my first tip off. If they are at NY melon. In what pool is each deed in and when did it get their? No way were they lost that is preposterous. Are they at Fanny/freddy/the Fed? Then what exactly is a MBS?

To date not one judge has even asked for and gotten actual documentation. What does that say about our system of justice? Thats why lawyers are not chiming in. That blind lady justice traded her scales for a hose.

I hope a grand jury can find the true answer to the question of where our titles are. How and when they got there? When that truth comes out it will not be polished, no it will be ugly.

Robo signers? Think their customers really didn't know? It would have then been conspiracy to commit fraud and the banksters lawyers would turned them into grated cheese. They knew these documents had to be forged or they wouldn't be produced.
