Oh Look, Handcuffs! (Catholic Church)

I'll be damned...

PHILADELPHIA—A Roman Catholic monsignor was sentenced Tuesday to as many as six years in prison for allowing a priest suspected of sexual misconduct with a minor to have continued contact with children.

A jury last month found Monsignor William Lynn guilty of child endangerment. The verdict marked the first time a senior U.S. church official was convicted of a criminal charge related to allegations of covering up sexual abuse of minors by other priests. Msgr. Lynn, 61, served as secretary for clergy in the Archdiocese of Philadelphia from 1992 to 2004, a job that included investigating abuse allegations lodged against priests in the diocese.

Now seize the facilities under the Archdiocese involved in the abuse and sell them, distributing the proceeds to the victims.

That would be justice (and make damn sure that the Church "gets the message.")

Incidentally, Penn State deserves to have exactly the same thing done to it.

Those who argue that these are the acts of "individuals" and thus the "institution" should not be penalized in this fashion are wrong.  A "corporate body" (e.g. "institution") is simply the agglomeration of the individuals who constitute it.  When those individuals use the power and prestige of the body as a whole to hide and promote unlawful acts the proper punishment is not just to jail the people involved, although that certainly must be done, but to also dissolve the entity that was complicit, if in fact there was complicity among multiple people in governance positions -- as appears to have been the case both here and at Penn State.

Corporate bodies by their nature are not "harmed" by fines as they simply pass through the financial damage to others.  But you can "jail" a corporate entity by suspending or revoking its corporate charter or seizing the physical instrumentalities that constitute it.  While revocation of a charter or seizure of the instrumentalities of the entity is effectively a "death penalty" and thus should be reserved for the harshest of offenses, this much ought to be clear: sexual abuse of children meets the criteria for imposition of sanctions in this class.

One must wonder what it's going to take for the so-called "death penalty" to be applied. Murder? Theft? If not child rape, then what? I also want to see audited proof that the $60 million fine goes directly and wholly to a good charity, if not directly to the families involved.

Visual - that $60 million fine is going to come from the pockets of the fine taxpayers of Pennsylvania. That's just wrong.

Yep. The just way to handle this is to sell the assets and distribute THOSE.

uhhh, PSU anyone?

Where are the criminal inditements of the Athletic office at least or the general administration officials? Where are the charges against the janitor, and that asst coach who *witnessed* the crime? They should be brought up for the EXACT same thing as this Monseignor. Where are the fines against PSU for damages? How about forfeiture of league certification for the same number of years child******was committed and tolerated for their football program and all program moneys including championship, TV, and bowl fees to be forfeited to the victims?

By that logic, sell and distrubute the assets of Penn State.

Yes Ilike. That's exactly what should happen -- at least those of the athletic department, and perhaps the entire university.

Gee with that precedent, time to arrest the pope and his buddies next time he comes in the US.

Same goes for congress for allowing all the financial fraud and not doing a thing about it, even giving them bailouts.

Same goes for state governors/legislature lying about the pension funds.

Etc...

There's an argument for it in the case of the Vatican; they pulled the infamous Boston guy back to Italy to prevent his prosecution and gave him a Bascilica to run over there, depriving his victims of the opportunity to obtain justice.

Unfortunately we have no jurisdiction beyond our borders, but we sure as hell do here in the United States.

This is a good start - but there should have been dozens of these enablers arrested and jailed years ago.

Ask any vice cop from decades gone by. Many departments routinely caught priests looking for willing partners in the parks at night. Few were charged. Mainly turned over to the bishops for internal action. Even repeat offenders. The cross and the sword has always had mutual cooperation. I bet if the truth were told about local governments turning a blind eye to sexual abuse of children by priests in the 20th century it would make Penn State look like a Sunday school picnic.

More commentary from SNAP (Survivors Network of those Abused by Priests):

Quote:

We are grateful that Msgr. Lynn was not able to escape with the minimum sentence for his years of concealing heinous crimes against children. But cover ups would be better deterred had he gotten the maximum penalty, and justice would have been better served.

Considering all the kids whose innocence was shattered (or, in some whose lives were lost to suicide), we believe that Msgr. Lynn deserved the harshest punishment.

Still, this sentence sends a powerful message: cover-up child sex crimes and you’ll go to jail. Not house arrest. Not community service. Not a fine. You’ll be locked up.

It says, loud and clear, that child sex crimes are taken extremely seriously, and will be punished as such.

...

We hope that those who see, suspect or suffer child sex crimes in any institutional setting will find the strength to come forward and make a report to police, especially now, since the Lynn case shows that sometimes, justice, prevention and healing are possible.

Within about five seconds of the verdict, local Philly television had a comment from the Archdiocese of Philadelphia, bemoaning the severity of the sentence and advocating its reduction, presumably on appeal. On the other hand, I was a little miffed that the judge didn't turn over the deed to the Basilica of Sts. Peter and Paul to the victims and order that St. Charles Seminary (Chuck's Monk House) be boarded up immediately. As to Penn State and its many sanctimonious area graduates, in various states of high dudgeon over the defrocking of St. Joe, what part of "child abuse" don't you dimwits understand?
