Bottom line is America, through the election of Obama and 60 democratic senators, voted for this. Will they now change their minds and elect 60(I'd argue you'd need 63-65) senators from another party to overturn this? Never happen. This is done folks. Thelma just dropped the hammer and I'm not so sure that's a bad thing.
The sooner we understand our current system is doomed, the sooner we can make the drastic changes that I think can only be made after the complete failure of the current system. I think the ballot box is done as a way of reform in America.

That's freedom, but only for one side.
The only hope is that this will accelerate the collapse of America, especially if the sickcare industry costs begin rising more than 9% a year.

So if I was the POTUS and wanted to raise taxes, then under the guise of personal safety I could require every adult citizen to purchase firearms for the protection of their persons, family and neighbors - then levy a tax on all those who refuse to arm themselves in order to pay for necessary law enforcement.

Seems I heard the tax has to actually be collected before it can be contested. Maybe there is a crack to get rid of this thing. But, we are talking another few years, unless the court chose to drop everything and rule.
The idea we have a young judge that was supposed to be on the other side of this issue, paired with a couple of Obama appointed women who believe there is no limit to what the government can tell us to do as long as it agrees with the government manufactured need to do so, puts the country closer to NAZI Germany than anything resembling a free Republic. The problem in the US is we have 2 NAZI parties. One only disguises its intentions in order to oppose the other in elections every 2 years. If this equality became plain to the eye of the electorate, one or the other party would fall. They are both engaged in organizing and regulating big business to control commerce, at the expense of the rest of us. There will never be any alternative that disagrees with this concept as long as the corporate criminals rule the day. The only victory was the fact states were not compelled to comply with the new Medicare.
There is one clear strike against Obama. That strike is we are guaranteed to get another justice like the 2 women he put on the court. I was banned from another site for calling the pot black, these NAZI Obama backers that came out in front in 2009. Nothing has changed this opinion and anyone paying attention that has a clue what totalitarian, state controlled societys are, would have to concur with my warning. The health care model was forced on us years ago and is nothing but a cartel monster. OPEC is a cartel, but we are not locked in a room with the OPEC monster. We are with Obama care, the US devised medical system and many other government policies, including screwing by bankers.

mannfm - i was going to ask the same question...
i thought if it is ruled a tax it can't be contested, the case can't be heard and the supremes have no standing to rule...
if it is a tax i don't know under what grounds someone could challenge this though...
btw, this could be a nightmare for the dems in election - they've been saying all along it's not a tax and voila quelle surprise it is after all.

It's actual more like a single party with 2 layers: The inner party is the Dems and the outer party is the GOP. Karl is right. The US Constitution has been on its sick bed. Today the US Supreme Court pushed it over the edge with all of us into the abyss of constitutional and rule of law anarchy.
America is a concept in the mind from the past which no longer exists. Today's America is a post-Christian anti-civilization that is in the process of self-negation. Our thinking about issues in America is dominated by concepts from the America from the past. Most older people carry this cognitive dissonance, living in the present while also living in the past. That is why so many keep voting for what is enslaving them. They are unconscious of the cognitive split within themselves. Only a crisis will force one to consciously face it.
Will this be the necessary crisis? I think not. The US is on tracks that it will not get off until the deepest darkest decline into the super debt cycle collapse has run its course, after which it has a fifty/fifty chance of re-establishing liberty and freedom or ending up a collectivist slave state. I am not optimistic. I expect the latter.

CJ Roberts seems to have switched (and switched late) because the dissent reads like a majority decision. Start halfway down p 25 of the dissent (p 151 of the PDF):
"Finally, we must observe that rewriting §5000A as a tax in order to sustain its constitutionality would force us to confront a difficult constitutional question: whether this is a direct tax that must be apportioned among the States according to their population. Art. I, §9, cl. 4. Perhaps it is not (we have no need to address the point); but the meaning of the Direct Tax Clause is famously unclear, and its application here is a question of first impression that deserves more thoughtful consideration than the lick-and-a-promise accorded by the Government and its supporters."
"Would force us to confront"? "we have no need to address the point"? Seems they have been forced and there is a need to address...
