What the hell is this?

A 17-year-old Houston honor student jailed 24 hours for missing too much  school likely spent the night surrounded by "every type of criminal that  exists," one Houston defense attorney said.

Diane Tran, an 11th-grade honor student at Willis High School near Houston,  was sent to jail for 24 hours last Wednesday by Judge Lanny Moriarty and ordered  to pay a $100 fine for excessive truancy.

Really?

When did this law change?

Apparently, somewhat recently.  Why?  Because for a long time you've been able to drop out of school when you're 16.  So how is it lawful to jail someone for not doing something that has become legally voluntary?

Oh, that's simple -- we change the law.  But wait -- this is a girl who's providing for her family, living in a broken home and her parent that is present is fully-aware of what she's doing!

In other words she quite-effectively has parental permission - which is what she needs to tell the school system to stick their "truancy" claims up their behind.

This is an outrage.  Diane Tran should respond to this crap by immediately taking the GED, which I'm quite certain she would pass.

Then she can march in with her parent, withdraw from school (legally) and give the legal finger to this judge, and in my opinion she damn well should do exactly that.

As for those of you who live in this county, perhaps a boycott of your businesses is in order if you sit for this and do not demand that this black-robed jackass expunge Ms. Tran's record, step down and publicly apologize.

Jailing a 17 year old, a person legally entitled to quit school with parental permission, who is an honor's student because she is supporting her family and is still able to maintain her status on the honor roll despite absences is the worst sort of jackbooted crap -- and one of the most-outrageous abuses committed by a black-robed jackass I've heard of in years.

This man must be removed from the bench.

Karl, FWIW part of the reason I keep coming back to the ticker is for the wildly eclectic posts you make; finance one minute, a jailed teen the next.

The event reported here is silly, another on a huge heap of mismanaged actions by school bureaucracies.

Agreed. I was outraged when read it too. The stupidity is getting extreme in every corner. Judges are supposed to have the highest powers of wisdom, yes ?

KD, Please post this judge's picture so all his associates and neighbors will know who he is and can express their disagreement in a legally appropriate manner. I recommend that they turn their back to him in his presence.

I'm 30 in Houston, if this was my kid I'd do exactly what you said. All while saying screw you to the school staff. Only problem with private education, aside from the cost currently, is I still have to pay prop taxes to support public edu.

Also I'm hearing the manditory vaccination for enrollment where there is no law. Its policy no law and if you push them you can get past that but they will lie all the way until the point where you let you pass.

That poor girl is obviously staying in school to better her opportunities in the future. She has waaaay too much responsibility. That judge has a head up the ass. Where are the parents and why isnt' the law after them for neglecting their children?!?

There are laws here in OK for how many days of school your kid can miss. I don't think age is a mitigating issue at all. There is also a graduated scale wherein as more-and-more days are missed, signatures are needed by more-and-more administrators to allow more absences. This also applies for kids in 'school' activities - sports, academic meets, band competitions, etc. If they go over without the required signatures it's a surefire visit from DHS.

Actually, the school administrators should be taken to task for having such easy classes that a kiddo could miss 3/4 of the days and still be an honors student.

To be fair, though, a honors student today isn't the honors student 20 years ago.

Regardless, the judge has his head up his ass.

Another totally weird comment from the steel, but you know, the judge did Ms Tran a favor. If the story is correct, Ms Tran has received $40,000 from those outraged by this case. $40,000 for spending one day in jail? Hmm, that's approaching Jamie Dimon level compensation for a misspent day.

Of course, this is an outrage - and all that rot, but if Ms Tran is smart, and I believe she is, she will use that money to start a business or go to college - a day peeing in an open toilet, smelling vomit, etc. for $40k? Where do I sigh up?

If she's gotten 40k then good for her. I am in agreement with publishing the judge's picture/info though so that he can be shamed into not doing this again.

This is linked to Texas school finance laws. I vomit every time I hear the propaganda taught in public schools and evidently they have set up the law to make for certain no one is left behind in learning the statist bull****. The judge, from what I recall, is a JP and I am kind of surprised JP court could put a kid in jail. The problem is the school district gets money only for days attended, thus the kid is depriving the teachers and more likely the criminal element that runs the public education system of their deserved money. EXTORTION RACKET.

Either the Judge is an idiot or he's brilliant. People have set up a fund for Ms. Tran and have collected 40k so far (from the link). Perhaps the Judge figured his sentence would draw attention to her plight? Well bingo, he hit the jack pot and made himself look like a fool doing it. It was a selfless sacrifice on the part of the Judge, 'hey, I look like the bad guy but just look at the results!'

I think instead the Judge is hounded by a pack of truancy officers and he made an example out of the wrong person for the wrong reasons.

If you think JPs are bad as wanna-be real judges, every constable "I wanna-be a real fuzz" I've ever met was worse. I mean they're raked up from the dredges who couldn't make it into the ranks of the city or sheriff departments, and spend their careers manning school crossings, chasing down truants, and serving divorce papers, so go figure.
