Well Well What Do We Have Here? (THC, Martin)

Oh, sweet Trayvon was -- possibly -- high the night he died?

Trayvon Martin, the 17-year-old who was shot and killed by a neighborhood watch volunteer, had the drug THC in his system the night of this death, according to new information obtained by ABC News.

....

The autopsy report shows traces of the drug THC, which is found in marijuana, in Martin's blood and urine.

Not metabolites, but THC itself?

The distinction is important.  THC itself is metabolized within a few hours by the body; you cease being "high" when the THC has been processed.  What remains, and is typically detected by cheap drug tests, are the metabolites of THC -- that is, the chemical byproducts that your body winds up with when it breaks down THC.

Those byproducts can stay in your system for a month or more, which is why you can get "busted" for smoking a joint two weeks ago on a drug screen.

But assuming the actual substance THC was found in the tox screen then we have a different situation -- Trayvon was probably actively high at the time he got into the altercation.

Why is this important?  It's critically important!  If you're drug-addled then you are not in your right mind -- by definition.  And that, in turn, means your judgment is impaired.  And one of the more-common side effects of marijuana use is paranoia.  Maybe enough paranoia to lead you to attack someone who you think -- without any reasonable belief -- is "out to get you"?

Oh, and as for the witness statement who actually saw the assault?

One resident told the investigator that he heard a commotion and when he investigated, "he witnessed a black male, wearing a dark colored "hoodie" on top of a white or Hispanic male who was yelling for help. He elaborated by stating that black male was mounted on the white or Hispanic male and throwing punches "MMA (mixed martial arts) style." He stated he yelled out to the two individuals that he was going to call the police. He then heard a "pop." He stated that after hearing the "pop," he observed the person he had previously observed on top of the other person (the black male wearing the hoodie) laid out on the grass.

Gee, Trayvon was mounted on Zimmerman and punching him "Mixed Martial Arts" style?  But but but..... he was shot in cold blood according to the media.

Hmmmm... and again, Martin had THC in his system.

So when Zimmerman told the dispatcher on the 911 call that he thought Trayvon "looked high", he was factually correct eh?

More when I can get to the (swamped and inaccessible) web site and get the document trove for myself.

I'm waiting until the Eric dick Holder DOJ and the FBI get done investigating if what Zimmerman did was a hate crime. Even though Zimmerman may be technically justified under the law it does not mean he is not still guilty of crime. Especially when you consider the fact that criminals are running our justice system.

It has been more than 25 years since I last used pot but I do not remember it ever making me feel aggressive in any way - far more the opposite. Its use by Trayvon should be irrelevant. What is relevant is whether or not Trayvon overreacted to an annoying provocation, which seems likely given consistent descriptions. You simply cannot start hitting someone just because they follow you - and expect to get away with it.

Overall, without having been there and knowing exactly what happened, I'm probably likely on Zimmerman's side.

However, with that, I don't see how the presence of THC in one's system has any relevance in this case. Whether he was high or not, what problem was he creating? Was there a victim from his being high?

I've never seen someone initiate physical force upon another simply because they had THC in their system, so I think this is a bit of a stretch.

So sorry, but seriously Carl, if you have ever been on THC, the last thing you want to do is bash someone's head on the pavement. If anything, this detracts from the defense.

Pot impacts everyone differently. But a sizable percentage of people have serious paranoid reactions to ordinary events when they're stoned. If that prompted him to think Zimmerman was "out to get him", it might have provided him reason to attack.

Maybe.

The other evidence, however, is all stacking up as I expected it would -- Zimmerman fired at close (but not contact) range, Martin had damage to his knuckles, Zimmerman did not (so he was not punching) and Zimmerman had multiple injures consistent with being pounded on including the wound on the back of his head.

Well, well, well... high racist stalker?

"Prosecutors on Thursday made public a trove of evidence used to justify murder charges against Neighborhood Watch volunteer George Zimmerman, including a police report that concluded "the encounter between George Zimmerman and Trayvon Martin was ultimately avoidable by Zimmerman."
....
Zimmerman himself was on a prescription for Tamazepam, according to the paramedic's incident report reproducing his medical records.
....
But after questions about possible racial motivation for the slaying, a special prosecutor took over the case and, on April 11, Zimmerman was charged with second-degree murder"

From side effects of Tamazepam by NIH:

"You should know that your mental health may change in unexpected ways while you are taking this medication. It is hard to tell if these changes are caused by temazepam or if they are caused by physical or mental illnesses that you already have or suddenly develop. Tell your doctor right away if you experience any of the following symptoms: aggressiveness, strange or unusually outgoing behavior, hallucinations (seeing things or hearing voices that do not exist), feeling as if you are outside of your body, memory problems, difficulty concentrating, new or worsening depression, thinking about killing yourself, confusion, and any other changes in your usual thoughts, mood, or behavior. Be sure that your family knows which symptoms may be serious so that they can call the doctor if you are unable to seek treatment on your own."

I don't think I've ever seen anyone aggressive while high on pot... paranoid yes.. aggressive no.

And I wouldn't trust a journalist's report to be nearly as specific as you're trying to be with regards to metabolites and actual THC. In fact, I would expect them to use the phrase "traces of THC" to refer to exactly what you're mentioning.

All that said, the other physical evidence is much more compelling from a self-defense stand point.

Out of curiosity, was Zimmerman drug tested?

I don't believe so, but his medical records are part of the file.

And inherently aggressive, no, but paranoid, yes. And that's not a good combination if you think "the man" is about to bust you for being stoned (especially if you just got busted for having drug "stuff" in your book bag!), then you discover it's not a cop......

It would also explain being willing to walk ~2 miles in the rain to get a bag of candy eh? smiley

One thing that does stand out to me, is how they mention Zimmerman yelling 14 times for help. If just one person had gotten involved..

Also.. Neighbor Watch peeps.. buddy system.. use it.

The ME report being discussed on CNN now says Trayvon was shot from "intermediate distance". An ME being interviewed on CNN says that translates to a firing distance of 6 to 12 inches.

I doubt the pot made Martin more aggressive, his assault and battery on Zimmerman was probably just part of his nature. In the other hand it seems that Zimmerman was quite right about something being wrong with Martin. He was high and didn't belong in the neighborhood. His suspicious of Martin were entirely justified.

Bj: "Intermediate" is anything beyond contact range (0 - a couple of inches) to a couple of feet. The distinction is that there are no powder burns beyond a couple of feet of range, so if they're present but there is no evidence of blast penetration into the target (if you press a muzzle into someone and fire the impulse of hot gas from the propellant will be injected into them and expand; that's VERY obvious on autopsy) then you have "intermediate range."
