The new rules allow existing copies of documents that may be sought by investigators to be destroyed.

The Selective Service System’s new privacy rules were published in the Federal Register on Tuesday, September 20, 2011, four days after the September 16 announcement by World Net Daily that the Maricopa County (Arizona) Sheriff’s Office “Cold Case Posse” was opening an inquiry with full subpoena power into alleged forgery of several documents concerning Obama’s birth and draft registration.

The new rules, which constitute the first update to Selective Service System privacy regulations in eleven years, were published under the title, “Privacy Act of 1974; Publication of Notice of Systems of Records.”

Ongoing controversy surrounding allegations that some of Obama’s personal identification documents and records, including his Selective Service draft registration form, are forgeries came into sharp focus seven months ago. The “Cold Case Posse,” under the leadership of Sheriff Joseph M. Arpaio, opened an inquiry in response to those allegations.

“This is a full-fledged criminal investigation,” Michael Zullo, lead investigator, told Communities @WashingtonTimes.

“Sheriff Arpaio sent two written requests in March to the Selective Service System requesting President Obama’s draft registration records. Selective Service System officials responded to Arpaio in writing, but did not turn over any of President Obama’s registration records.”

“We believe they are stonewalling,” Zullo added. "In their latest reply letter to the Sheriff, they do not comment on, or even allude to, the microfilm being available to inspect."

Changes in the wording of the privacy rules alters the status of federal records, like the requested draft registration records, from “record copies” to “nonrecord copies.” Nonrecord copies are subject to disposal.

Previously unnoticed, the new rules allow the government to destroy microfilm copies of Selective Service registration records and may create new obstacles for law enforcement agencies that are requesting records access for investigative purposes.

This change also hampers media organizations and government watchdog groups from seeking records access under the Freedom of Information Act (FOIA). A second change, to a section of the rules governing the sharing of information with state and local governments, seems aimed squarely at blocking inquiries like the one launched by the Cold Case Posse.

If microfilm copies of selective service records are destroyed, it would make it difficult to prove whether or when Obama registered with the Selective Service. At issue is whether he attended Occidental College in Los Angeles as a foreign student, possibly using an Indonesian passport. Foreign students are not required to register with the Selective Service, hence if there were no record of his registration, this would raise questions about Obama’s legal status at that time. Was his status that of a U.S. citizen or a foreign student, possibly with dual passports?

A paper copy of Obama’s selective service registration card, called a form “SSS-1,” was obtained days before the 2008 elections through a FOIA request by Stephen Coffman, a retired Immigration and Customs Enforcement (ICE) agent. A spokesperson from ICE, an agency of the U.S. Department of Homeland Security, confirmed that Coffman retired from the agency in June, 2007.

Our eligibility cases simply point out that the Supreme Court has already decided that no person can serve as President unless both of their parents were U.S. citizens at the time of their birth. Our reward for making this simple observation is to be called liars, unethical, stupid, and many other slanderous names. But the most amusing accusation thrown our way so far is that our eligibility challenge itself is unconstitutional.

Last week Liberty Legal Foundation filed documents in both the Arizona and Tennessee eligibility lawsuits, opposing the Defendants’ multiple motions to dismiss our cases. In their motions the defendants claim that our lawsuit is unconstitutional because, according to them, the electorate has the authority to determine whether a candidate is constitutionally qualified to serve as President.

Considering the poor job our public schools have done teaching about the Constitution, I wouldn’t be surprised to hear this argument coming from a member of the media. But to have this argument actually filed in federal court, by an attorney that supposedly understands constitutional law, is surprising and sad.

Our response remains the same: The Constitution is an anti-democratic document. One of its primary functions is to protect the rights of individuals against a tyrannical majority. In other words, some rights cannot be taken away even if 99.9% of the population wants to take them away, at least not without first amending the Constitution. So, 99.9% of the population can vote for Obama, but he is still Constitutionally barred from serving as President because his father was never a U.S. citizen. The electorate simply does not have the authority to change the Constitutional requirements for the President.

This is Constitutional Law 101, but apparently we’ve fallen so far away from our Constitutional Republic that we have to remind attorneys and courts of this basic fact.

The defendants also argued that granting our lawsuit and preventing the DNC from sending nomination letters stating Obama is eligible for the Presidency would violate the Democratic Party’s First Amendment rights. We responded that the First Amendment does not grant the Democratic Party a right to commit fraud.

Of course the defendants also tried their favorite argument: that we don’t have standing to sue. However, the 9th Circuit recently ruled that Independent Presidential candidates have the right to sue competitor Presidential candidates. Our first named Plaintiff is Independent Presidential Candidate John Dummett. Mr. Dummett clearly has standing, according to the 9th Circuit. It is also well established that if one Plaintiff has standing to sue, then all the Plaintiffs can proceed with their lawsuit which includes every Liberty Legal Foundation member that has joined the Certification Class Action. So, assuming the courts follow precedent, we should defeat these motions.

Last week, Bennett told a different Phoenix radio station it was “possible” he would keep Obama off the state’s ballot in November if Hawaii did not provide him with a satisfactory answers to his investigation.

On Tuesday, Bennett told talk show hosts Mac Watson and Larry Gaydos he had no idea about the wave of criticism he endure get after launching his investigation into the president’s birth certificate. He said again that he doesn’t consider himself a birther and he believes the president was born in Hawaii but he did this to satisfy a small number of vocal people who kept sending him angry emails about it.

“I feel like I was just trying to glue the far little corner of the carpet down,” Bennett said. “And as soon as you just touch the carpet, the whole floor buckles.”
