The unofficial czar of the new Consumer Financial Protection Bureau, Elizabeth Warren, told Congress last week that her organization is "the most constrained and the most accountable agency in government," and then repeated similar claims on CNBC Tuesday. If nothing else, you have to admire her nerve

That's nice.  However, the fact of the matter is that the CFPB has no actual power in the form of actually doing anything other than setting forward more "rules" that will be broken without consequence.

There are already plenty of laws that constrain all the conduct that caused the bubble in housing and the subsequent collapse.  It's illegal to sell loans to someone while knowing that the representations you made are not met by the borrowers.  We have sworn testimony that 60% of the loans sold were in such a state in 2006, and 80% in 2007.  We also have private suits that assert 90% fraud rates in this regard in some of these securities.  Number of people and banks indicted for selling this paper while knowing it was trash?  Zero.  How long would a local gas station manage to sell fuel without being put out of business and the owner jailed if 80% of every gallon pumped was water?  If 80% of the roofs put on by a contractor were defective?  If 90% of the eggs in a store were rotten?  If 80% of the tires sold by the local store would blow out on the highway?  If 90% of the cars sold by a manufacturer would explode when hit from behind?

Ms. Warren was also disingenuous about the bureau's role in the ongoing mortgage settlement negotiations with banks, telling Congress the Justice Department and other agencies asked for the bureau's "advice." She added the bureau "will not be a party to any formal settlement," which is technically true because its powers don't vest until July. But that raises the question of the legality of its involvement in the negotiations now.

What's wrong with talking to people?  Is there some special exemption in the First Amendment for people the Wall Street Journal doesn't like?  The last time I checked it was supposed to apply to everyone. 

Incidentally, don't take this as an endorsement of the so-called "settlement negotiations."  There should be no settlement.  What there should be is prosecutions for each and every felony that has taken place.  Every single perjured document should result in a criminal charge.  If there's a pattern of conduct established then Racketeering should be investigated, charged, and tried and if proved then treble damages and criminal sanction should be imposed.

We have plenty of laws already.  The problem isn't that Elizabeth Warren is putting together the CFPB, it's that the entire concept of a CFPB is a joke and a fraud upon the public in the first instance.  The more byzantine you can make a set of laws or regulations the more you can wave your arms and pretend to be doing something important while accomplishing nothing at the same time the Jester is stealing all the cookies right out from under your nose.

The banking industry has turned this sort of Washington DC hand-waving into an art form.  We have seen money laundering, passing of funds to and from barred nations such as Iran while intentionally obscuring the source or destination of funds, crooked sewer contracts in Jefferson County Alabama and well over a trillion dollars in bogus mortgages made and peddled worldwide.  Any of these, standing alone, should have been enough to shut all of these firms down.

The real scam is that we continue to fall for the false claims and people screaming and shouting about that which will do nothing to stem the scams and frauds, for the simple reason that we need no new laws to sanction the conduct that took place. 

Without a prosecutor who will actually prosecute all we're doing is making noise to divert the public's attention while the thieves steal all the loot.

Warren is a Goldfish in a shark tank. They will always marginalize her. She has genuine concern for the "little people" - so the "big fish" will never let her do anything significant. They don't fear her, she fears them.

For the 1000th time - we simply need these implements to get anywhere! It won't stop until they are, LITERALLY!

I like Warren. The seminar she gave at UC on "The Coming Collapse of the Middle Class" was enlightening and I still listen to it occasionally (you can get it through Youtube).

She is an academic though and I was afraid that she would not have the "muster" do take on the system. I wish her luck.

None of the steps taken thus far were neccesary.
Not FinReg/Dodd-Frank, not the AIG Rescue, not TARP, not HAMP, not QE; absolutely none of it.

The Insolvent Institutions should have been recapitalized by converting the Stock Holders and Bond Holders or liquidated and the Bankster Criminals and Financial Terrorists should have been prosecuted and asset stripped.

I have reched the conclusion that the US Government is wholly captured and that Justice and Reformation of The Republic can only be accomplished via Revolution.

This can be done relatively peacefully if the Citizenry defund and obstruct the function of Government.

If Every single American restricted their spending to the barest essentials, changed their with-holding to deprive the Government of weekly revenue, and filed an extension on April 15th; a clear message - a vote of NO CONFIDENCE - would be sent.

The Beast must be defied and starved.

if the banks do settle with .Gov— that won't get them off the hook for wave of lawsuits coming from those defrauded in securities

They go along with some fake b.s. about reform and protecting the little sheeple all the while knowing it is fake and will only be used in some spin b.s. to show they are on the sheeple side , all the while they are sucking contributor c*** and never intended for anything of substance to be done.

Why this clown and his whole bunch of retards has not been impeached is only due to the utter cowardice and corruption of the rethugs, not to mention the traitors in the demoncrats.

The WSJ can't stand Warren because she's a liberal. But, as KD has noted 1000 times -- reform of the banking system, and bringing criminals to justice isn't a democratic/republican issue. It's a national imperative. If we don't do it, we're doomed. Warren gets this, and she's a force for good, imho.

She has consistently been a voice in favor of the American middle-class. She's smart, speaks extremely clearly, and knows her material cold. The oligarchy hates her, and like Brooksley Born, they'll do anything they can to marginalize her.

Now that she is officially in the public sector, I expect the headwinds to increase ...

As an academic at Harvard, Warren admirably described many of the roots of our problems. So what are TPTB to maintain the status quo?

Oh hell, that's an easy one. Just sucker her into heading up some new-fangled, toothless .gov agency, where she can enjoy a grand title and no power to do squat except hand wave like a beauty queen.

i cant take the left-right lib-con bs anymore
demonizing the other side regardless of its accuracy on the specific point

i actually kinda like this warren what id like to see is her in charge
of something that could actually improve things that is id like to see
about 3-4 govt econ agencies eliminated and warren put in charge of
whichever one left having the longest claws

im for 100% govt transparency and i care not what or who it effects
no more cia no more fbi i dont care ill take my chances w/ good people

I will say though ... given how OBVIOUS this Ploy/Trap was for her, I'm more than little astonished that she walked right in.

I would have thought, given her previous writings, etc., that she'd have told them to take flying leap. Especially AFTER Owebama did nothing but further enrich the banksters in his first 12 months. At that point, she should have walked.

Maybe they thought they could assimilate her? Just think how many people in NYC and DC would **** their pants if they appointed someone like Brooksley Borne (sp?) to the position.
