You have to be kidding me...

Shortly after Labor Day, as polls continued to sink, the Democratic National Committee (DNC) realized it needed a cash infusion for the upcoming midterm elections. Its chairman, former Virginia Governor Tim Kaine, turned to the Bank of America to secure a $15 million revolving credit line. Then, in the middle of this month, the Democratic Congressional Campaign Committee (DCCC) got another loan from BofA for an additional $17 million.

Problem: Was the loan adequately collateralized - that is, truly "arms length"?

Worse: Two days before the loan was closed, the DNC apparently changed its privacy policy - it appears they may have effectively pledged their donor and contact lists without the consent of most of the people on them!

The DNC loan agreement as posted online by the Federal Election Commission (FEC) and signed by former Virginia Governor Tim Kaine (D) on September 16, 2010, says the loan collateral included: “All electronic mail (‘E-mail’) addresses and other contact lists, records and other Information (electronic or otherwise) relating to contributors, supporters and subscribers owned by any of the Borrowers.” The borrowers in this case were the DNC and the DNC Services Corporation.

The loan agreement further stipulates that if the Democrats defaulted, Bank of America would be entitled to “proceeds from any fundraising activity, refunds, reimbursements, or proceeds from the rental or sale of mailing, contact or subscription lists or Information (electronic or otherwise).”

WHAT?!

More to the point, are those lists worth anywhere near the amount of these loans?

Because if they're not, then the loan could be ruled a DONATION to the DNC, and that, coming from the bank, would be black-letter illegal.

Gee, given that Bank of America is accused of serious due process violations related to foreclosures, and has admitted to 102,000 "robosigned" documents which can be argued is an admission of the commission of 102,000 counts of perjury, do we have an appearance of bribery to go with the appearance of an illegitimate "campaign donation"?

BAC, incidentally, denies this is an improper transaction.  Of course with The Democrats running the Administration, what do you think the odds are of an impartial look at this from the FEC?

Holy ****! Why in the hell hasn't more people picked up on this? It isn't like this is super top secret or anything. It's public information!

The R's should be screaming about this from the rooftops(they are the only ones who will). Hopefully that will get this more out into the open.

**** ME. They're not even trying to hide it any longer. If this doesn't show the Republic is over, I'm not sure what DOES. Think it's time to inventory the ammo (again) and order some more .223 - it might not make a difference overall, but dammit it'd make ME feel better.

Oh my God, Karl, I hope he goes to jail. I am in VA and despise Timmy as no other.

I hope no one holds their breath on Holder taking action, though. That guy is fully bought and paid for.

When he ran for Governor, he clearly stated, many times, that he would not raise taxes.

He broke his promise in the first week of his administration.

We need to find out what the real collateral is for these loans. BofA claims that the donor list is only a small part. They claim "future cash flow and history of repaying loans" as justification, according to the original article being quoted by KD.

So, a good credit score gets you a loan, even if you're the DNC.

Rumors are that BoA is securitizing the DNC loan. Some investors in Greece (the public pension fund) like the AAA rating on the super senior tranche. The junior tranche might be a tough sell (collateralized by the "supporters cash flow") but it's covered.

If history is any indication (it took "them" about 4 years to get around to Mozillo, after you started harping on his manipulative shannigans/cover-up on the Yahoo stock BB for CFC) I would expect that they will deal with this issue sometime in the year 2014 or 2015, if ever !

Just a guess.

You're ahead of the curve Karl, unless you can enlist enough followers to shorten the curve. More power to ya. And Yes I made some nice dough shorting CFC ...and a bunch of mortgage insurers, and a few US banks ..so a belated thanx !

Is it really illegal? It seems to me that after the newly activist Supreme Court gave the green light to bribery in the Citizen's United decision, unlimited "campaign contributions" by corporations is considered "free speech." That's a decision that a number of people on this forum applauded.

Of course, bribery in exchange for mailing lists is a new variation on the theme. But hey, if corporations are free to bribe in exchange for favors, it scarcely matters whether the briber is rewarded by the bribee with mailing lists, bailouts, military contracts or the White House furniture.

Personally, I thought Citizen's United was an appalling decision. Corporations are not "persons" and bribery is not "free speech." But if you disagree, well, this particular scandal shouldn't bother you.

And you ain't seen nothing yet. This coming election will be the most corrupt yet. After November, maybe the CEO of Goldman-Sachs gets appointed as next Secretary of the Treasury (we've got a precedent for that, don't we?). Perhaps Angelo Mozilo will come out of retirement to be the next SEC chairman. Bernie Madoff might get pardoned to become attorney-general.

Almost nothing shocks me anymore. The USA is rapidly devolving into a banana republic.

Actually, under long-standing law, it's not.

Citizens United did not permit unlimited donations. It permitted direct buys of advertising. There are VERY strict limits on how much you can actually give and how.

I would think that the value of the list would be very subjective. But if it was not authorized that in itself may invalidate any value. No?
